Terms of Service

Brainamine helps you learn in an ADHD-friendly way, without exhausting your brain. We may add, change, or remove features over time.

Brainamine is currently available only to people who have reached their 14th birthday. If you are under 14, you may not create or use a Brainamine account at this stage. We ask for your date of birth before you use the Service, and store it with your account when you create one; we use it to decide eligibility, to apply the rules that change with age, and to control purchases. If you are 14 to 17 you are a minor: you may use Brainamine, and a purchase needs the authorisation of your parent or guardian. We are working on a safe way for users younger than 14 to use Brainamine; that way does not exist yet.

You are responsible for keeping your login credentials secure and for activity under your account. Please notify us promptly of any unauthorised use.

You keep ownership of the content you upload (your "Content"). You grant us a limited licence to host, process, and display your Content solely to operate and provide the Service to you – including sending it to our AI providers to generate your study content. You confirm you have the right to use and upload your Content.

You agree not to misuse the Service, including: uploading unlawful, infringing, or harmful content; attempting to disrupt or reverse-engineer the Service; or using it to violate others' rights. We may suspend accounts that breach these Terms.

If you choose to share a quiz, we create a copy of that quiz and publish it at a public link on our domain (a /q/ address). Anyone who has the link can open it and take the quiz, without an account. Shared pages are excluded from search-engine indexing, but a link can be forwarded by anyone who receives it – treat sharing as publishing.

Licence you grant us. You keep ownership of what you share. For as long as a share link is active, you grant us a non-exclusive, worldwide, royalty-free licence to store, copy, display, and make that shared quiz publicly available through the Service, and to pass it to the hosting providers we use for that purpose. The licence ends when you revoke the link or we remove the quiz, apart from copies that remain briefly in backups or caches. We do not use shared quizzes for anything else.

What you may not share. Only share content you have the right to share. You must not share content that: infringes anyone's copyright or other rights; contains personal data about other people; is unlawful, defamatory, hateful, sexual, or harassing; endangers minors; contains malware or links to it; or is advertising, spam, or unrelated to learning.

You can revoke at any time. Revoking a share link in the app stops it working immediately. Deleting the underlying material, or your account, also removes the shared copy.

Our takedown right. We may remove or block a shared quiz, and may switch off sharing for an account, if we consider the content unlawful, infringing, harmful, or in breach of these Terms – whether or not anyone reported it. Where we can, we tell the person who shared it and say why.

Reporting unlawful content (notice and takedown). Every shared quiz page carries a "Report" link. You can also write to hello@brainamine.app with "Takedown notice" in the subject line. Please include the link (the /q/ address), what is unlawful about it, and how to reach you. We confirm receipt, review, and act without undue delay; we tell you the outcome and the reasons for our decision. For content that users enter, we act as a hosting provider within the meaning of Art. 6 of Regulation (EU) 2022/2065 (Digital Services Act), and this notice-and-action process follows Art. 16 of that Regulation. We do not monitor shared quizzes in advance, but we act once we are aware of unlawful content.

Your study content and explanations are generated automatically by AI and refined by our team to keep quality high. As with any automatically generated content, they may still contain errors or inaccuracies, and are provided for learning and study support only – not as professional, medical, legal, or financial advice. Always verify important information.

Paid plans (Pro, Premium, Believer, Founder) are service contracts, not the supply of digital content on a tangible or non-tangible medium. This matters for your withdrawal right, set out below.

Pricing, trial terms, billing and cancellation are shown to you before purchase. Payments through our direct checkout are processed by Stripe, our payment provider; if you subscribe through the Apple or Google app store, that store's terms and billing govern instead of this section.

You can cancel a recurring plan (Pro or Premium) at any time, effective at the end of the current billing period. One-time plans (Believer, Founder) run for the fixed term stated at purchase (2 years for Believer, 3 years for Founder) and are not cancelled mid-term; the withdrawal right below is the only way to end one early.

Buying on brainamine.app. Paid plans bought on this website are sold by Brainamine and billed through Stripe, our payment provider, which also issues your invoice. Your card details are handled by Stripe and never reach us.

Your right of withdrawal

As a consumer, you have the right to withdraw from this contract within 14 days without giving a reason. The withdrawal period is 14 days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Hanna Surova, Seitenstettengasse 5/37, 1010 Vienna, Austria, hello@brainamine.app) of your decision to withdraw from this contract by an unequivocal statement (for example by e-mail). Sending your notice before the withdrawal period ends is enough.

If you withdraw effectively, we refund all payments received from you – less, where applicable, the proportional amount under the following section – without undue delay and at the latest 14 days after the day your withdrawal notice reaches us. For that refund we use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you.

When the withdrawal right ends early

If, at the time of purchase, you expressly asked us to begin providing your plan before the 14-day withdrawal period ends, and you acknowledged that you thereby lose your right of withdrawal, the following applies:

Early lapse. Your right of withdrawal ends as soon as we have fully provided your plan within those 14 days.

Proportional payment on earlier withdrawal. If you withdraw before we have fully provided the plan within those 14 days, you owe us a proportional amount for the part of the plan you have already used. That amount is calculated as follows:

days used ÷ days in the period × period price

"Period" means: for Pro and Premium the current billing cycle; for Believer 730 days (2 years); for Founder 1095 days (3 years) – in each case the full term purchased.

"Days used" run from the moment your plan started to the moment your withdrawal notice reaches us.

Model withdrawal form. Complete and send us this form only if you wish to withdraw from the contract. The Service itself – including the Brainamine name, branding, software, and design – belongs to us and is protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.

The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that the generated content will be accurate.

To the extent permitted by applicable law, Brainamine shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under Austrian law.

You may stop using the Service and delete your account at any time (see Account deletion). We may suspend or terminate access if you breach these Terms or where required by law.

These Terms are governed by the laws of Austria, and the courts of Vienna shall have jurisdiction, without affecting any mandatory consumer-protection rights you have in your country of residence.

We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, notify you of material changes.

These Terms are provided in several languages for your convenience. The English version is the reference version and prevails in the event of any conflict, except that for consumers habitually resident in Austria or Germany the German version prevails, and nothing displaces mandatory consumer-protection rules of your country of residence.
